This Health & Fitness Disclaimer applies to the Active Fit 55+ program offered at Flow Academy BJJ, 3600 Central Ave, Ste 3, Riverside, CA 92506 (“Flow Academy,” “we,” “us,” or “our”). Please read this carefully before participating in any class.

1. Consult Your Physician

Active Fit 55+ involves physical movement, including agility and balance work, resistance and strength training, and low-impact interval training. Before beginning this or any new exercise program, you should consult your physician or other qualified healthcare provider, particularly if you have any existing medical condition, injury, or concern. Flow Academy coaches are fitness instructors, not medical professionals, and do not diagnose, treat, or provide medical advice regarding any condition.

2. No Medical Claims

Nothing in our marketing, website, blog content, or in-class coaching is intended to state or imply that Active Fit 55+ treats, cures, prevents, slows, or reverses any medical condition, including but not limited to arthritis, osteoporosis, diabetes, high blood pressure, Parkinson’s disease, or dementia. Any benefits described — such as improved mobility, increased daily energy, or feeling less stiffness in everyday movement — reflect general member experience and program design goals, not medical outcomes or guarantees. Individual results and experiences will vary.

3. Inherent Risks of Physical Activity

Participation in any physical fitness activity carries inherent risks, including but not limited to the risk of muscle strain, joint injury, falls, cardiovascular events, or other physical injury. These risks exist even when classes are coached, low-impact, and beginner-friendly, and even when participants follow all instructions given by coaches.

4. Assumption of Risk

By choosing to participate in Active Fit 55+ classes, you voluntarily assume all known and unknown risks associated with participation, to the fullest extent permitted by California law. This general disclaimer is not a substitute for, and does not replace, a signed liability waiver and assumption-of-risk agreement, which Flow Academy BJJ requires all participants to review and sign in person prior to their first class.

5. Your Responsibility

You are responsible for:

  • Informing your coach of any injuries, medical conditions, or physical limitations before class begins
  • Modifying or stopping any movement that causes pain, dizziness, shortness of breath, or discomfort
  • Using any equipment (bands, weights, mats) as instructed
  • Wearing appropriate clothing and following mat etiquette (classes are conducted in socks or barefoot on padded mats)

6. Emergency Situations

If you experience chest pain, severe dizziness, shortness of breath, or any other concerning symptom during class, stop immediately and notify a coach. In a medical emergency, call 911.

7. Limitation of Liability

To the fullest extent permitted by California law, Flow Academy BJJ, its owners, coaches, and staff are not liable for any injury, loss, or damage arising from participation in Active Fit 55+ classes, except to the extent such liability cannot be waived or limited under applicable law. This provision is not intended to and does not waive liability for gross negligence or willful misconduct where such a waiver would be unenforceable under California law.

8. Relationship to Signed Waiver

This document is informational and does not, by itself, constitute a legally binding waiver of liability. All participants are required to review and sign Flow Academy BJJ’s official liability waiver and assumption-of-risk agreement before participating in any Active Fit 55+ class. In the event of any conflict between this document and the signed waiver, the signed waiver governs.

[Attorney review note: this draft must be reconciled with, and should not be treated as a replacement for, the studio’s actual signed liability waiver and assumption-of-risk form used at intake. Confirm enforceability of liability limitations under California law (including Civil Code protections and case law on gross negligence), and confirm any additional disclosures required for a program specifically marketed to adults 55+.]
